By accessing and using Pickleball Presswire ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

Pickleball Presswire is a newswire distribution service focused exclusively on pickleball-related news and announcements. We provide a platform for users to create and distribute press releases to our curated media list for a fee of $50 per release or via credit packs (5 credits for $199).

3. User Responsibilities

When using our Service, you agree to:

• Provide accurate and truthful information in your press releases
• Only submit content that you have the right to distribute
• Not submit spam, malicious content, or misleading information
• Comply with all applicable laws and regulations
• Respect intellectual property rights of others

4. Payment Terms

Each press release distributed through Pickleball Presswire costs $50 USD, or you can purchase a 5-pack of credits for $199 USD ($39.80 per release). Credits are valid for 12 months from purchase date. Payment is required at the time of scheduling. All fees are non-refundable once a press release has been distributed or scheduled for distribution within 24 hours. Unused credits expire after 12 months and cannot be refunded.

Refund Policy: Refunds may be issued at our discretion if:

• Technical issues prevent distribution of your press release
• You cancel more than 24 hours before the scheduled send time
• We determine the press release violates our content guidelines before distribution

5. Content Guidelines

We reserve the right to reject or remove any press release that:

• Contains false, misleading, or defamatory information
• Violates intellectual property rights
• Is not relevant to pickleball
• Contains inappropriate or offensive content
• Violates any applicable laws or regulations

6. Distribution

We make reasonable efforts to distribute your press release to our curated media list on the scheduled date and time. However, we do not guarantee that any media outlet will publish or cover your release. Distribution timing may vary based on technical factors.

7. Intellectual Property

You retain all rights to the content of your press releases. By submitting a press release, you grant Pickleball Presswire a non-exclusive license to distribute, display, and promote your content as part of our services.

8. Limitation of Liability

Pickleball Presswire is not liable for any damages arising from the use or inability to use our Service, including but not limited to direct, indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for the specific press release in question (up to $50 USD or the per-credit value if paid via credit pack).

9. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We may also update these Terms of Service periodically, and continued use of the Service constitutes acceptance of any changes.

10. Termination

We reserve the right to terminate or suspend your access to the Service at any time, for any reason, including violation of these Terms of Service.

11. Governing Law

These Terms of Service are governed by the laws of the State of Colorado and the United States. Any disputes arising from these terms or use of the Service shall be resolved in the state or federal courts located in Boulder County, Colorado.
